These terms govern your use of Heaven Hugs, operated by Jordan Oliver Rose, trading as Heaven Hugs (ABN 32 641 759 540), Victoria, Australia ("we", "us", "our"). By using heavenhugs.com you agree to these terms.

The service

Heaven Hugs creates memorial portraits with artificial intelligence. You upload a photo of yourself and a photo of a loved one, choose a style, and we create a portrait of you together. You can buy a digital download or a printed canvas, framed or unframed.

Uploading photos

By uploading photos you understand and agree that:

  • your photos are sent to our AI provider (OpenAI) only to create your portrait
  • previews you do not buy, and their photos, are deleted after 3 days
  • purchased portraits are kept for 12 months for downloads and reprints
  • your photos are handled as described in our Privacy Policy

Your responsibilities

  • Upload only photos you own or have permission to use
  • Give accurate contact and shipping details
  • Use the service lawfully
  • Do not misuse or try to reverse-engineer the service
  • Do not upload offensive, unlawful or copyrighted images you have no right to use

Photos of people

Our portraits show real people. By uploading, you confirm that:

  • you have the consent of every living person shown, or are their parent or guardian if they are under 18
  • for a person who has passed away, you are family or otherwise have a genuine right to use their photo
  • you are responsible for these permissions, and you will cover us for any claim that arises if they were not in place

Content we may refuse

We may review, refuse or remove any upload or portrait that breaks these terms, cancel orders that contain objectionable content, and report illegal content to the authorities.

Who owns what

Your photos: stay yours. You give us a limited licence to use them only to create your portrait.

Your portrait: you receive a personal licence to use, print and share it. We will never use your portrait or photos in our marketing without your written permission.

Commercial use: portraits are for personal use. Resale or commercial use needs our written permission.

About AI portraits

Portraits are created by artificial intelligence. Results depend on the photos you upload, and AI art is an interpretation, so we cannot guarantee an exact likeness. That is why you see a free preview before you pay. By buying, you accept the portrait you previewed.

Age

You must be 18 or older to use Heaven Hugs.

Orders and payment

Prices are shown in your local currency and include any GST or VAT that applies. Payment is processed securely by Shopify Payments. By completing a purchase you authorise us to charge the total shown at checkout. Refunds are covered in our Returns & Refunds policy.

Limitation of liability

To the maximum extent allowed by the Australian Consumer Law and other laws, we are not liable for indirect or consequential loss from using the service, and our total liability for any claim is limited to the amount you paid for that order.

Nothing in these terms excludes, restricts or changes any right, remedy or guarantee under the Australian Consumer Law, or the consumer laws of your country, that cannot lawfully be excluded.

Indemnity

You agree to cover us against claims, losses and reasonable legal costs that arise from content you upload, your breach of these terms, or your breach of anyone else's rights, including privacy or image rights.

Ending use

We may suspend access to the service if we believe these terms have been broken.

Changes

We may update these terms. Using the service after a change means you accept the new terms. We will post important changes on this page.

Governing law

These terms are governed by the laws of Victoria, Australia, and disputes go to the courts of Victoria. If you live elsewhere, nothing here removes your rights under your own country's consumer laws.
